Admittedly, it will probably take a court to force you to do it, but the legal situation is such that you will be liable for the fee because you signed a contract that contained such language in it.

You should read your transport contracts very carefully. Most contain a cancellation clause. The clause is written in favor of the shipping company, which is to say it is written against you. This clause is negotiable and most will remove it. That will only happen, however, if you make a fuss about it.
