Shipping your car may seem like a fairly simple process, but occasionally it can be a maddening adventure. The pickup and delivery times are often an issue of consternation with clients. This brings us to the subject of the language in the contract regarding cancellation of the delivery.

You live in Los Angeles and, miracle of miracles, have been offered a great job in New York City. The only problem is you have to start in five days. In a panic, you start boxing up and shipping your personal items. Next you call a shipping company to have your car transported to New York since you don't have time to drive it. You agree on a price and sign a contract. The company is supposed to arrive on Saturday morning to pick up the car, which works out great because your flight is Sunday night.

Saturday morning arrives and there is no truck. The afternoon passes and you call the company. The truck is supposedly on the way. It doesn't show. The company is closed on Sunday and no truck shows! You fly to New York bent out of shape and with a car stuck in your old garage. You arrange for another company to ship it and have a friend drop it off at their office. A month goes by and you get an invoice for $400 from the first shipping company for "cancellation" of the contract! Now it is rage time!

This scenario happens more than anyone in the shipping industry would like to admit. That being said, you, the miffed client, are going to end up paying the fee. Admittedly, it will probably take a court to force you to do it, but the legal situation is such that you will be liable for the fee because you signed a contract that contained such language in it.

You should read your transport contracts very carefully. Most contain a cancellation clause. The clause is written in favor of the shipping company, which is to say it is written against you. This clause is negotiable and most will remove it. That will only happen, however, if you make a fuss about it. Cancellation fees are some of the biggest points of aggravation with most shipping clients. Make sure you read your contract and avoid any such problems.
